                                                 J U D G M E N T (oral)

1. Petitioners herein seek quashing of FIR No. 858/2021 dated 30.11.2021, registered at police station Tilak Nagar for commission of offences under Sections 498A/406/34 IPC along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties.

2. The marriage between complainant (respondent No.2 herein) and petitioner was solemnized on 27.09.2020, as per Sikh rites and customs. There is no issue from such wedlock.

3. However, on account of temperamental and irreconcilable differences, the parties started residing separately and on the basis of one complaint filed by respondent No.2 before the CAW Cell, the abovesaid FIR was registered.

4. Charge-sheet has been filed and even the Charges have been framed.

5. However, when the parties were referred to Delhi Mediation Centre, Tis Hazari Courts, Delhi, on 01.02.2025, they came to amicable resolution of

the matter and agreed to part ways in a graceful manner as would be apparent from Settlement Agreement dated 01.02.2025.

6. Respondent no. 2 is present in person and she has been duly identified by her counsel as well as by investigating officer. She reiterates the terms of settlement as mentioned in Settlement Agreement dated 01.02.2025. She submits that there is already a divorce between them by way of mutual consent and the copy of decree dated 13.10.2025 has also been placed on record. She stated that she has agreed to accept a sum of Rs. 6,50,000/- as full and final settlement in lieu of alimony, istridhan, maintenance for self (past, present and future). She has already received an amount of Rs. 3,40,000/- lacs. The balance amount of Rs. 3,10,000/- has been paid today by way of demand draft bearing No. 990688 dated 19.01.2026 drawn on Punjab National Bank.

Respondent No.2 submits that she has entered into the abovesaid settlement out of her own free will, without any coercion and influence from any corner whatsoever and therefore, she would have 'no objection' if FIR in question is quashed. Her affidavit to abovesaid effect is also on record. She, however, submits that there is some delay in filing the present quashing petition and therefore, the petitioner should be burdened with cost, particularly, in terms of Clause VI of the Mediation Order dated 01.02.2025.

8. The next date of hearing before the learned Trial Court is stated to be 04.04.2026.

9. Learned counsel for the petitioner submits that the present petition was filed in the month of January but, on account of certain objections pointed out by the Registry, there is some delay in placing the present petition before the Bench.

10. In view of the settlement arrived at between the parties, continuing with

criminal proceedings would serve no useful purpose, especially, when dispute does not involve any public interest and is, primarily, private in nature. In any case, even the complainant does not wish to press any charges against the petitioners.

11. Accordingly, exercising inherent powers vested in this Court under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, it is deemed appropriate to quash the instant FIR.

Consequently, to secure the ends of justice, FIR No. 858/2021 dated 30.11.2021, registered at police station Tilak Nagar for commission of offences under Sections 498A/406/34 IPC along with all consequential proceedings arising therefrom, quashed subject to cost of Rs. 25,000/- to be deposited by the petitioner with Shahdara Bar Association Advocate Welfare Fund, Delhi (saving Account No. 90100100003204 IFSC-UCBA0002078, UCO Bank, Karkardooma Court, Delhi) within two weeks from today. Proof of deposit of cost and original affidavits of the parties be submitted before the learned Trial Court within further two weeks.

13. The petition stands disposed of in aforesaid terms.
