J U D G M E N T (oral)
1. The present petition seeks quashing of FIR No. 0597/2021 dated
30.07.2021, registered at Police Station Tilak Nagar, Delhi for commission of
offences under Sections 498A/406/354/377/34 IPC, along with all consequential
proceedings emanating therefrom, on the basis of compromise arrived at
between the parties.
2. The charge sheet has already been filed and, admittedly, though several
other offences were also mentioned in the charge sheet, the learned Trial
Court has framed charge under Section 498A/34 IPC only qua all the
petitioners.
3. Copy of order dated 20.05.2025 has also been placed on record in order
to corroborate the abovesaid contention.
4. Petitioner No.1 got married to respondent No.2 on 28.01.2021.
5. Respondent No.2, however, left her matrimonial home on account of
some temperamental differences and started residing separately within a short
span of one month of marriage i.e. since 23.02.2021. She also reported the
matter to the police, which resulted in the registration of the abovesaid FIR on
30.07.2021.
6. Now the parties have entered into settlement and, in terms of such
settlement, the parties have obtained divorce, by way of mutual consent, on
23.12.2025.
7. The terms of settlement would also indicate that the respondent No.2
has agreed to part ways in a graceful manner and without any consideration in
lieu of maintenance, alimony and istridhan. She reiterates the abovesaid
during the course of the proceedings. She is accompanied by her father and
has been duly identified by the I.O., who is present in Court.
8. Petitioner No.3 has joined the proceedings through video conferencing.
9. All the other matters/complaints, related to the marriage in question,
have also been withdrawn by the respective parties.
10. In view of the settlement arrived at between the parties, continuing with
criminal proceedings would serve no useful purpose, especially, when dispute
does not involve any public interest and is, primarily, private in nature. In any
case, even the complainant does not wish to press any charges against the
petitioners.
11. Accordingly, exercising inherent powers vested in this Court under
Section 528 of the BNSS, it is deemed appropriate to quash the instant FIR.
12. Consequently, to secure the ends of justice, FIR No.0597/2021 dated
30.07.2021, registered at Police Station Tilak Nagar, Delhi, along with all
consequential proceedings emanating therefrom, is hereby, quashed.
13. The petition stands disposed of in aforesaid terms.
