J U D G M E N T (oral)
1. Petitioners herein seek quashing of FIR No. 0659/2021, registered at
Police Station Mayur Vihar Phase-I, for commission of offences under
Sections 498-A/406/354/34 IPC, along with all consequential proceedings
arising therefrom, on the basis of compromise arrived at between the parties.
2. Respondent no. 2 got married to Mr. Arun Rathore on 04.03.2017 as
per Hindu rights and customs.
3. However, due to some matrimonial discord, she lodged a report with
the police which resulted in registration of aforesaid FIR. FIR is directed
against seven accused persons. However, her husband has not been made
accused as she had no grievance against him.
4. Charge-sheet has, though, been filed but charges have yet not been
ascertained.
5. Respondent no. 2 has joined the proceedings through
video-conferencing and she has been identified by investigating officer.
6. When asked, she submitted that she is, now, residing at a separate floor,
albeit, in the same premises.
7. Matter has been amicably settled between the parties and copy of
Compromise Deed dated 08.06.2025 has been placed on record.
8. Signatures of respondent no. 2 i.e. second party in MoU has been
redacted as there are allegations of commission of offence of outraging of
modesty by two of the petitioners.
9. However, copy available with the learned counsel for petitioner has
been seen, which contains her signatures also.
10. Respondent No. 2 has reiterated the terms of settlement and submits
that she has amicably settled all her disputes with the petitioners, with whom
she is left with no grievance of any nature. She submits that she has entered
into settlement, voluntarily and without any force or pressure.
11. It is also apprised that there was one more civil case and in view of the
settlement, such other civil matter has already been withdrawn.
12. In view of the settlement arrived at between the parties, continuing with
criminal proceedings would serve no useful purpose, especially, when dispute
does not involve any public interest and is, primarily, private and matrimonial
in nature.
13. Accordingly, exercising inherent powers vested in this Court under
Section 528 of the BNSS, it is deemed appropriate to quash the instant FIR.
14. Consequently, to secure the ends of justice, FIR No. 0659/2021
registered at Police Station Mayur Vihar Phase-I, for commission of offences
under Sections 498-A/406/354/34 IPC, along with all consequential
proceedings emanating therefrom, is hereby, quashed.
15. The petition stands disposed of in aforesaid terms.
16. Pending applications also stand disposed of in aforesaid terms.
