1. This hearing has been conducted through hybrid mode. CM APPL. 22833/2026 (for Exemption)
2. Allowed, subject to all just exceptions. The application stands disposed of.

3. The present petition has been filed under Article 227 of the Constitution of India, assailing the orders dated 24th March, 2026 and 06th March, 2026 passed by the learned Trial Court in Execution Petition No. 83/2026, whereby the application filed by the petitioner/ Judgment Debtor (JD) seeking 06 (six) months' time period for vacation of the suit property has
been dismissed.
4. Learned counsel for the respondent/Decree Holder (DH) appears on advance notice and accepts notice.
5. Heard. Record perused.
6. Learned counsel for the petitioner/Judgment Debtor (JD) on instructions, submits that the JD would vacate the suit premises on or before 31st July, 2026. It is further submitted that the petitioner shall pay a sum of Rs. 1,00,000/- towards arrears of rent/damages on or before 30th April, 2026; Rs. 1,50,000/- on or before 31st May, 2026; Rs. 1,25,000/- on or before 30th June, 2026; and the balance amount of Rs. 1,25,000/- on or before 31st July, 2026.
7. The aforesaid proposal of the petitioner has been agreed by learned counsel for the respondent.
8. Keeping in view these submissions, the petitioner is directed to file an affidavit-cum-undertaking accordingly as per his submissions in the Court within a period of 10 (ten) days from today.
9. Accordingly, as per that undertaking, the JD would vacate the suit premises on or before 31st July, 2026 and shall pay a sum of Rs. 1,00,000/- towards arrears of rent/damages on or before 30th April, 2026; Rs. 1,50,000/- on or before 31st May, 2026; Rs. 1,25,000/- on or before 30th June, 2026; and the balance amount of Rs. 1,25,000/- on or before 31st July, 2026.
10. In the event of any default by the petitioner in complying with that undertaking, any amount already paid shall stand forfeited. The respondent/Decree Holder shall be at liberty to move an appropriate application for early hearing before the Execution Court to execute the decree.
11. The learned Execution Court is directed to defer the execution
proceedings to a date subsequent to 31st July, 2026
12. The present petition is disposed of in the above terms. Pending application(s), if any, also stands disposed of.
