1. Both these petitions, being connected, have been taken up together.
2. These petitions seek quashing of FIR No.364/2021 dated 27.07.2021,
registered at PS Jaitpur, for commission of offences under Sections
498A/406/34 IPC and of FIR No.556/2020 dated 01.11.2020, registered at
PS Jaitpur, for commission of offences under Sections 323/354/506/509/34
IPC along with all consequential proceedings arising therefrom, on the basis
of compromise arrived at between the parties..
3. Both the FIRs have been registered at the instance of respondent No.2
herein.
4. The marriage between complainant i.e. respondent No.2 and petitioner
No.1, in CRL.M.C. 2311/2025, was solemnized on 24.02.2016, as per Hindu
rites and customs. They were blessed with three daughters.
5. However, on account of temperamental differences, the parties started
living separately and when complaints were made by respondent No.2, it
resulted into registration of the abovesaid FIRs.
6. However, when the matters were referred to Mediation Centre, Saket
Courts, the parties were able to resolve all their disputes amicably on
02.12.2024.
7. When these petitions were received earlier, the petitions were directed
to be placed before Joint Registrar (Judl.), and on 04.04.2025, the parties
made comprehensive statements before the learned Joint Registrar (Judl.)
and order dated 04.04.2025 would also indicate that the Investigating Officer
was also present before the learned Registrar and had duly identified both the
parties. The Compromise Deed/Settlement Deed was also found to be
genuine and the learned Registrar also observed that the consent of both the
parties was there and there was nothing to indicate that such consent was

obtained under any influence or pressure.
8. As far as CRL.M.C. 2311/2025 is concerned, it was initially directed
against the five accused persons but in the interregnum, petitioner No.3
Meena (mother-in-law of respondent No.2) has, reportedly, expired. They
are facing trial for commission of offences under Sections 498A/406/34 IPC.
9. As far as CRL.M.C. 2312/2025 is concerned, the husband and
father-in-law of respondent No.2 are facing trial for commission of offences
under Sections 323/509 IPC only.
10. Respondent No.2 is present in person with her counsel and she has also
been duly identified by the Investigating Officer, who is present in Court.
11. When asked, respondent No. 2 reiterates the term of settlement taken
place before Mediation Centre, Saket Courts on 02.12.2024. She also
submits that there is already a divorce between them by way of mutual
consent on 13.02.2025 and that two of her daughters are under guardianship
of petitioner No.1 and one daughter is under her guardianship. She states that
she has entered into the abovesaid settlement out of her own free will,
without any coercion and influence from any corner whatsoever and,
therefore, she would have 'no objection' if FIRs in question are quashed.
Both the sides assure that they would adhere to the terms of settlement in true
letter and spirit.
12. In view of the settlement arrived at between the parties, continuing with
criminal proceedings would serve no useful purpose, especially, when
dispute does not involve any public interest and is, primarily, private in
nature. In any case, even the complainant does not wish to press any charges
against the petitioners.
13. Accordingly, exercising inherent powers vested in this Court under

Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, it is deemed
appropriate to quash the instant FIR.
14. Consequently, to secure the ends of justice, FIR No.364/2021 dated
27.07.2021, registered at PS Jaitpur, for commission of offences under
Sections 498A/406/34 IPC and FIR No.556/2020 dated 01.11.2020,
registered at PS Jaitpur, for commission of offences under Sections
323/354/506/509/34 IPC, along with all consequential proceedings arising
therefrom, is, hereby, quashed.
15. Original affidavits, copies of which have been placed on record in the
present proceedings, shall be submitted before the learned Trial Court within
two weeks, so that these become part of Trial Court Record.
16. The petitions stand disposed of in aforesaid terms.
17. Pending applications also stand disposed of in aforesaid terms.
