1. This hearing has been conducted through hybrid mode. CM APPL. 21407/2026 (for exemption)

2. Allowed, subject to all just exceptions. Application is disposed of. CM(M) 709/2026 & CM APPL. 21406/2026 (for stay)

3. The present petition has been filed by the petitioner/defendant under Article 227 of the Constitution of India, 1950, assailing the orders dated 01st September, 2025 and 03rd December, 2025 passed by the learned Trial Court in Civil Case No. 2314/2024 whereby the right of the petitioner to file his written statement has been closed and an application seeking condonation of delay in filing the written statement has been dismissed respectively.

4. Heard. Record perused.

5. Learned Counsel for the respondent has appeared on advance notice and accepted notice.

6. Learned Counsel for the respondent submits that the respondent has no objection if the written statement of the petitioner is taken on record, subject to payment of exemplary costs.

7. Keeping in view the aforesaid stand taken by the learned Counsel for the respondent, the delay in filing the written statement is condoned and the written statement be taken on record subject to the payment of costs of Rs. 10,000/- to the respondent before the trial court.

8. Accordingly, the present petition is disposed of in the above-stated terms. Pending application(s), if any, also stands disposed of.
