                                              J U D G M E N T (oral)

1. Both the petitions emanate from cross FIRs and, therefore, these have been taken up together.

2. First petition relates to FIR No. 261/2019 dated 24.09.2019, registered at Police Station Mohan Garden in which there are three accused persons. Such FIR has been lodged on the basis of complaint made by respondent no. 2 (name withheld) who revealed about commission of offences under Sections 323/354/354(B)/34 IPC. In the aforesaid incident, her daughter was also molested.

3. On the same day another FIR i.e. FIR No. 260/2019 was registered which relates to commission of offences under Sections 323/379/356/354/354(D)/452/34 IPC. The accused in such FIR are respondent no. 2 in the cross-case, her daughter and her son.

4. During the pendency of the aforesaid two matters, when parties were referred to mediation, they were able to resolve all their disputes. The settlement terms are recorded in Mediation Order dated 20.07.2022 which took place under the aegis of Mediation Centre, Dwarka Courts, New Delhi.

5. Both the sides are neighbours and it is apprised that they have, voluntarily and amicably, settled all their disputes without any coercion, pressure, force and undue influence and without any monetary consideration and that they would have no objection if the respective FIRs are quashed.

6. Complainants in both aforesaid FIRs are present with their counsel and investigating officer and they have been duly identified by them.

7. Incident is of the year 2019 and when asked, both the sides submitted that they continue to reside in the same neighbourhood in complete peace and harmony and reiterate the terms of settlement as recorded in the aforesaid Mediation Order dated 20.07.2022.

8. Both the learned counsel for parties submit that since parties were not earlier advised to seek quashing of the FIRs, there was delay in approaching

this Court.

9. In Narinder Singh & Ors. vs. State of Punjab & Anr., (2014) 6 SCC 466, the Apex Court observed that proceedings, even in non-compoundable cases, can be quashed on the basis of settlement provided that the Court is satisfied that there was no meaningful purpose in continuing with the proceedings, and that the scope of conviction was remote and bleak. Reference be made to Gian Singh v. State of Punjab & Anr. (2012) 10 SCC

10. Keeping in mind the overall facts of the case, the fact that parties have amicably settled their all disputes, continuing with criminal proceedings would serve no useful purpose.

11. Accordingly, exercising inherent powers vested in this Court under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, it is deemed appropriate to quash both the FIRs.

12. Consequently, to secure the ends of justice, FIR No. 261/2019 and FIR No. 260/2019, registered at Police Station Mohan Garden, along with all consequential proceedings arising therefrom, are quashed.

13. The petitions stand disposed of in aforesaid terms.

14. The pending applications also stand disposed of in aforesaid terms.
