MAT.APP.(F.C.) 219/2017 & CM APPL. No. 45843/2017 (stay) Mr. Shyam Sunder Sharma, the respondent is present in-person before this Court and undertakes to pay total sum of Rs.10,00,000/- (Rupees Ten Lakhs Only), out of which, sum of Rs.6,00,000/- (Rupees Six Lakhs Only) is paid today and further undertakes to pay the balance amount of Rs.4,00,000/- (Rupees Four Lakhs Only) in three equal installments of Rs.1,33,333/- (Rupees One Lakh Thirty Three Thousand Three Hundred Thirty Three Only) each, within a period of 06 months from today i.e by or before 01.02.2023; within a period of 12 months from today i.e. by or before 01.08.2023; and the

MAT.APP.(F.C.) 219/2017 Page 1 of 3 final installment within a period of 18 months from today i.e. by or before 01.02.2024.

Directed accordingly.

The undertaking furnished on behalf of Mr. Shyam Sunder Sharma, the respondent, is accepted requiring him to comply therewith, without demur.

Ms. Meera Devi, the appellant, who is the former wife of Mr. Shyam Sunder Sharma, seeks leave to withdraw the present appeal, subject to receiving the sum of Rs. 10,00,000/-, from the latter in the installments, as recorded hereinabove.

Leave granted.

Acting in pursuance to the amicable settlement arrived at between the parties, before the Court today, Mr. Shyam Sunder Sharma, has handed over a cheque of Rs.6,00,000/- bearing No. 000122, dated 01.08.2022, drawn from UCO Bank, Karkardooma Courts, District Court Complex, New Delhi, in favour of Ms. Meera Devi. The respondent undertakes that, this cheque will be honoured on presenting.

Ms. Meera Devi, the appellant acknowledges receipt of the said amount of Rs.6,00,000/-, subject to encashment of the said cheque.

Needless to state that , it is full and final settlement of all claims, in relation to all the pending litigation between the parties including but not limited to the payment of maintenance, alimony etc. The parties undertake that they will not continue or institute any fresh proceedings with regard to each other. It is further clarified that Ms. Meera Devi will not make further claims with respect to the following proceedings:

Ms. Meera Devi, undertakes that she shall withdraw the Complaint Case No.38/IX/2012 filed U/s 498A in the Ld. District Court of Mathura, Uttar Pradesh titled as Meera Devi Vs. Shyam Sundar Sharma;

Ms. Meera Devi, further undertakes to withdraw the case filed under the Protection of Women from Domestic Violence Act, 2005 against Shyam Sunder Sharma;

Ms. Meera Devi shall also withdraw the application filed under section 24 H.M.A., 1955 in the Case no. 38/33 of 2006, titled Shyam Sundar Sharma Versus Meera, filed under section 9 H.M.A., before the Family Court of Laxmangarh, Distt. Alwar, Rajasthan, by Mr. Shyam Sunder Sharma; and Ms. Meera Devi will not claim any maintenance in present case prospectively.

No further directions are prayed for, in the present appeal. The appeal is disposed of as having been amicably settled. The pending application also stands disposed of.
