                                                            JUDGMENT

SANJEEV SACHDEVA, J. (ORAL)

1. The hearing was conducted through video conferencing.

2. Appellant impugns the order dated 22.12.2020 whereby the Trial Court has restrained the appellants from directly or indirectly dealing in services (class 45) under the impugned mark Regina Legal/AAS Regina Legal or under any other deceptively similar mark with the registered trade mark of the respondent no.1 'Reina Legal Advocates'.

intervention of learned counsel appearing for the parties, the disputes between the parties have been resolved and Settlement Agreement dated 12.01.2021 has been entered into. The settlement terms have been sent over email of the court master. The same are taken on record.

4. Learned counsel for the parties, under instructions, state that the parties undertake to abide by the terms and conditions of the Settlement Terms. I have examined the Settlement Terms and find the same to be lawful.

5. The respective undertaking given by the parties is accepted.

6. The appeal along with pending applications are, accordingly, disposed of in terms of the Settlement Terms. Consequently, the suit filed by the respondent no.1 is also decreed in terms of the Settlement Terms. Further, the application filed by the respondent/plaintiff before the trial court alleging breach of the injunction order is dismissed as withdrawn. The Trial court shall pass a consequential decree in terms of the Settlement Terms.

7. The Settlement Terms shall form part of the order.

8. Copy of the Order be uploaded on the High Court website and be also forwarded to learned counsels through email.
