1. The hearing was conducted through video conferencing.

2. Petitioner seeks a direction to the Trial Court to consider and decide the application of the petitioner seeking vacation of stay.

3. Learned counsel for the respondents submits that the petitioner himself has at times been the cause of delay of the proceedings. He, however, concedes that directions may be issued for expeditious disposal of the entire proceedings. In view of the above, without commenting upon the allegations and counter allegations and without going into the issue as to who has been responsible for the delay in the progress, as in these proceedings there is an issue with regard to encashment of a bank guarantee which has been injuncted by Court, it would be expedient to direct the concerned Court to expeditiously consider and dispose of the petition.

5. In view of the above, this petition is disposed of with a direction to the Trial Court to expedite the proceedings and endeavour to conclude the same expeditiously.

6. Copy of the Order be uploaded on the High Court website and be also forwarded to learned counsels through email.
