CM (M) 454/2020 & CM APPL.22692/2020 (stay)

1. The hearing was conducted through video conferencing.

2. Petitioner had impugned order dated 21.07.2020, whereby, application of the respondent under Order 38 Rule 5 CPC was allowed and petitioner was directed to furnish a security in the sum of Rs.3,50,000/- by way of a fixed deposit receipt in the name of the Court.

3. Parties were referred to mediation. Parties have settled their disputes through mediation and a Settlement Agreement dated 09.11.2020 has been placed on record. In terms of the Settlement Agreement, petitioner had agreed to pay a sum of Rs.2,60,000/- as full and final payment and settlement towards satisfaction of all claims of the respondent in the subject suit.

4. It is contended that the said payment has already been remitted by the petitioner to respondent.

5. Learned counsel appearing for the respondent acknowledges receipt of the entire settlement amount and submits that in view of the above settlement respondent does not wish to proceed with her suit and has already approached the Trial Court seeking withdrawal of the suit.

6. In view of the above, the Settlement Agreement dated 09.11.2020 is taken on record.

7. The present proceedings are, accordingly, disposed of in terms of the settlement agreement.

8. Copy of the judgment be uploaded on the High Court website and be also forwarded to learned counsels through email.
