ORDER
% 20.11.2019
D.N. PATEL, CHIEF JUSTICE (ORAL) CM Nos. 49901, 49902, 49903/2019 (exemption)
1. Exemption allowed, subject to all just exceptions.
2. The applications are disposed of.
LPA 726/2019
1. This Letters Patent Appeal has been preferred by the original petitioners whose W.P.(C) 3143/2018 has been adjourned to 17th December, 2019 vide order dated 17th October, 2019 (Annexure A-1) and hence the original petitioners have preferred the present appeal.
2. Having heard learned counsel for both the sides and looking to the facts and circumstances of the case, we see no reason to entertain this appeal because it is not tenable in law. No rights and liabilities of this appellants has been decided by the learned Single Judge by the impugned order dated 17th October, 2019. Simply the writ petition has been adjourned to 17th December, 2019. Hence, there is no substance in this appeal and the same is therefore dismissed. Nonetheless, liberty is reserved with the appellants (original petitioners) to mention before the learned Single Judge for preponement of the date.
3. Counsel appearing for the respondents submit that they have no objection if date of hearing of the W.P.(C) 3143/2018 is preponed by the learned Single Judge. It is further submitted by the counsel for the respondents that they are ready and willing to argue their case and they will not ask for any unnecessary adjournments.
4. With these observations, this appeal is hereby dismissed.
