% 19.11.2019 D.N. PATEL, CHIEF JUSTICE (ORAL)

1. This Public Interest Litigation (PIL) has been preferred with the following prayers:

"(a) Issue appropriate writ directing the respondents to fill the existing vacancies of teachers in time bound manner in government schools of NCT of Delhi.

(b) Issue broad guidelines, in the alternative for transportation mechanism of government school students

on the line and pattern of private schools and explore the feasibilities and possibilities for budgetary transportation of the students.

(c) Issue a direction to explore the possibilities of nursery and kindergarten education in all the government schools of NCT of Delhi on the pattern of private schools.

(d) Issue any other appropriate writ that this Hon'ble Court may deem fit and proper in the facts &, circumstances of the case."

2. Having heard counsel for both the sides and looking to the facts and circumstances of the case, it appears that several grievances have been ventilated in this writ petition for filling-up of the vacancies of teaching and non-teaching staff in schools and providing therein other infrastructural facilities including drinking water.

3. Counsel appearing for the respondent no. 3 submits that counter affidavit has already been filed by the respondent no. 3 wherein it has been stated that appointment process of 9232 vacancies for the posts of teachers is underway. She further submits that selection process is already over for 9232 vacancies to the posts of teachers and only final posting is to be done subject to certain verifications. We have also been pointed out by counsel for the Respondent No.3 that one CCP No.1133/2016 is also going on before the learned Single Judge, in which certain directions have been given by the learned Single Judge for filling-up further vacancies of 15000 teachers.

4. In view of these submissions, we see no reason to further monitor this case. Nonetheless, we hereby direct the respondent no. 3 to fill-up the vacancies of teaching and non-teaching staff at the earliest. We

further direct the respondents to provide drinking water in the Government schools as well as wherever there is a need of upliftment of infrastructural facility, the same shall also be evaluated by the concerned respondent and remedial steps to this effect shall be carried out at the earliest.

5. With these observations, this writ petition is hereby disposed of.
