SANJEEV SACHDEVA, J. (ORAL) Crl.M.A.3105/2019 (exemption)

Exemption is allowed subject to all just exceptions. CRL.M.C. 761/2019 & Crl.M.A.3104/2019 (stay)

1. Petitioner seeks quashing of FIR No.1533/2014 under Sections 341/506/34 IPC, Police Station Hari Nagar.

2. Allegations in the FIR are that the complainant, who is a singer

had sung a song, of which, the music was produced by the petitioner. There were disputes with regard to the sharing of the amount and the money spent on the production. It is alleged in the FIR that the petitioner threatened the complainant with a gun and demanded his share of the money spent on producing the song.

3. Parties have settled their disputes and a Compromise Deed dated 15.01.2019 has been executed.

4. Petitioner as well as the complainant are present in Court in person. They submit that they have sorted out their disputes with the intervention of friends and family and being from the same industry they have agreed to work together with each other again in future if circumstances so permit.

5. Complainant is present in Court in person and is identified by the Investigating Officer. He submits that he has settled his disputes with the petitioner and does not wish to prosecute his complaint any further.

6. Subject FIR has been registered under Sections 341/506/34 IPC and subject offences are compoundable in terms of Section 320 CrPC. Petitioner has approached this court as chargesheet has not yet been filed in this case.

7. In view of the fact that the disputes between the parties have been settled and respondent/complainant has stated that he does not

wish to press charges and has no objection to quashing of the subject FIR, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.

8. In view of the above, the petition is allowed. FIR No.1533/2014 under Sections 341/506/34 IPC, Police Station Hari Nagar and the consequent proceedings emanating therefrom are, accordingly quashed.

9. Order Dasti under signatures of the Court Master.
