JUDGMENT
SANJEEV SACHDEVA, J. (ORAL)
1. Petitioner seeks interim bail for a period of two months in FIR No.122/2018 under Sections 15/25 NDPS Act, Police Station Crime Branch on the ground that he is suffering from several ailments and requires urgent surgery.
2. As per the medical documents, petitioner has been diagnosed with Hypertension with Umbilical Hernia with chronic swelling right leg and advised surgery. Petitioner was taken for surgery at Deen Dayal Upadhyay Hospital but he refused surgery.
3. Learned counsel for the petitioner submits that the surgery was
proposed in Deen Dayal Upadhyay Hospital and petitioner would like to have the surgery performed from a private hospital as petitioner is suffering from several other complications and has also been diagnosed with Elephantiasis Leg (Lymphatic Filariasis) as well as Hydroceli.
4. Learned counsel for the petitioner submits that the petitioner is a permanent resident of Delhi and resides with his family.
5. Keeping in view the totality of facts and circumstances, I am satisfied that the petitioner has made out a case for grant of interim bail for the purposes of his medical treatment.
6. Accordingly, on petitioner furnishing a bail bond in the sum of Rs.50,000/- with one surety of the like amount to the satisfaction of the Trial Court, petitioner shall be released on interim bail for a period of four weeks subject to the following conditions:
(i) Petitioner shall not do anything which may prejudice either the trial or the prosecution witnesses.
(ii) Petitioner shall duly inform the Investigating Officer of the name and address of the hospital where the petitioner is admitted.
(iii) Petitioner shall also forward his regular medical documents to the concerned Investigating Officer.
(iv) Petitioner shall not leave the country without the permission of the Trial Court.
(v) Petitioner shall surrender his passport, if any, to the Investigating Officer, if not already done so.
7. Petition is disposed of in the above terms.
