CORAM:
HON'BLE MR. JUSTICE SUNIL GAUR
ORDER
(ORAL)
Impugned order of 27th September, 2018 directs petitioner to pay interim maintenance of ₹14,000/- per month in proceedings under Section 125 of Cr.P.C.
Learned counsel for petitioner assails the impugned order on the ground that petitioner has to pay rental of about ₹7,000/- per month and has to incur other expenses and the interim maintenance granted by the trial court is on higher side and it needs to be suitably reduced. On the contrary, respondent's counsel supports the impugned order and submits that there is no illegality in it. Upon hearing and on perusal of impugned order and the material on record, I find that the admitted income of petitioner is ₹26,899.25/- per month and respondent has a minor daughter aged about 7 years to
support. Petitioner does not have any dependents. In such a situation, amount of interim maintenance of ₹14,000/- per month to respondent is just and reasonable.
Finding no infirmity in the impugned order, this petition is accordingly disposed of.
