ANGAD SINGH SURI ..... Petitioner
Through Ms. Himangi Kapoor, Ms.
Prerna Sharma and Mr. Ankit Anand, Advs.
versus
CENTRAL BOARD OF SECONDARY
EDUCATION AND ORS. ..... Respondents
Through Mr. Atul Kumar, Adv. for R-1
CORAM:
HON'BLE MR. JUSTICE C. HARI SHANKAR
% J U D G M E N T (ORAL)
1. The petitioner completed his schooling from the Respondent
No.1-school.
2. At the time of his enrolment in the said school, his name was
entered in his admission form, as "Angad Singh Suri", his father's
name was entered as "Pawandeep Singh Suri" and his mother's name
was entered as "Awleen Kaur Suri".
3. It appears that, till his 9th Class, the school records of the
petitioner reflected his name and the name of mother and father as
above i.e. as contained in the admission form.
4. However, it is averred that, in the mark sheet issued by the
respondent-CBSE for the 10th Board class undertaken by the
W.P.(C) 12541/2018 Page 1 of 3
petitioner, the surname "Suri" was not reflected and that the names of
the petitioner, his father and mother were shown as ""Angad Singh",
"Pawandeep Singh" and "Avleen Kaur" respectively.
5. Qua the names of the petitioner and his father, therefore, the
error was only in the omission of the surname "Suri", whereas, in the
name of the petitioner's mother, her first name was also misspelt as
"Avleen" instead "Awleen" instead of which was reflected in the
Admission Form of the petitioner and his school records till class 9th.
6. The same error is reflected in the migration certificate and
passing certificates issued by the CBSE.
7. The writ petition avers that, despite repeated attempts made,
with the CBSE, to have the above errors corrected, nothing fruitful
resulted, as a consequent of which the petitioner has had to move this
Court by means of the present writ petition.
8. This writ petition, therefore, seeks a writ of mandamus, to the
Respondents, to correct the name of the petitioner, as well as his
parents, in the class 10th and class 12th mark sheet, the passing
certificate and migration certificates issued by the CBSE.
9. As the correction sought by the petitioner, if allowed, would
bring the records of the CBSE in harmony with the admission form of
the petitioner as well as in the petitioner's school records every year
till the 9th class, there can possibly be no objection to the prayer of the
W.P.(C) 12541/2018 Page 2 of 3
petitioner.
10. The applicable instructions also permit such correction, and the
request for correction has been made within the period stipulated
therein, reckoned from the date of declaration of the results of class
10th and 12th.
11. Mr. Atul Kumar, learned counsel for the CBSE, fairly leaves the
matter to the court.
12. Accordingly, the Respondent No.1-CBSE is directed to effect
the requisite changes in the names of the petitioner, his mother and
father, as reflected in the mark sheets of the class 10th and class 12th
Board examinations, the migration certificate and the passing
certificates issued by it.
13. The petitioner is also directed to submit the original certificates,
containing the erroneous details.
14. The writ petition is, consequently, allowed in terms of the
prayers contained therein.
15. There shall be no orders as to costs.
