1. The petitioner seeks interim bail in case FIR No.189/2014 under Sections 302/307/34 IPC read with Section 25/54/59 of the Arms Act, PS Mehrauli, on the ground that his mother has to be operated for Gall Bladder stone.
2. It is contended that the father of the petitioner is also suffering from severe heart ailment and there is blockage of 92% in his artery and he is not capable of looking after himself and even his wife is not keeping well. Surgery has been advised for 15.03.2018.
3. Learned Counsel for the Petitioner submits that earlier also petitioner
was released on interim bail for the treatment of his wife, by order dated 31.03.2017 in Bail Appln No. 318/2017. He submits that the petitioner duly surrendered in terms of the said order.
4. As per the status report, the medical records and surgery have been verified.
5. It is contended in the status report that there have been allegations that the petitioner along with the co-accused had threatened some of the witnesses at the time when they appeared for deposing their statements.
6. It is pointed out by the counsel for the petitioner that all public witnesses have already been examined and only officials/Police witnesses are remaining for examination.
7. Keeping in view the totality, the petitioner is admitted to interim bail for a period of two weeks from the date of his release, subject to his furnishing personal bond in the sum of Rs.25,000/- with a surety of the like amount to the satisfaction of the Trial Court.
8. The petitioner shall not do anything, which shall either prejudice the trial or any of the prosecution witnesses.
9. The Bail Application is accordingly disposed of in the above terms.
