1. Petitioner's request, for allotment of Type-IV quarter by counting the past service, made on 07.05.2018 is declined by second respondent by merely observing that the recommendation for allotments of flats has taken place and any change in flat allotment can be discussed in the next round of allocations only.

2. To assail the declining of petitioner's request, learned counsel for petitioner has drawn attention of this Court to the minutes of the House Allotment Committee of the second respondent which reveals that the said Committee has made a recommendation for implementation of the Government of India rules for counting past service and the review of the existing rules for allotment of residences to second respondent's

employees has to be considered by the Board of Management of second respondent.

3. Upon hearing and on perusal of the material on record and the Rules for Allotment of Residences to NIEPA's employees, I find that the compliance of the House Allotment Committee's recommendation (Annexure P-9) has to be made on priority. Let it be done within a period of twelve weeks and thereafter petitioner's request for allotment of Type- IV quarters by counting past service be re-considered by way of a speaking order within four weeks and the outcome be made known to petitioner within two weeks thereafter, so that petitioner may avail of the remedies available in law, if need be.

4. With the aforesaid direction, this petition and the applications are accordingly disposed of.

Copy of this order be given dasti to learned counsel for the parties.
