Exemption is allowed subject to all just exceptions. CRL.M.C. 3800/2018 & CRL.M.A. 28974/2018

1. Petitioner seeks quashing of FIR No.57/2013 under Sections 354/341/323/506 at Police Station Sunlight Colony. Parties are neighbours.

2. The allegations in the FIR are that the petitioner had misbehaved with the respondent, however, with the intervention of other members of the locality as well as the mediator, parties have settled their disputes before the Mediation Centre, Saket Courts and a settlement agreement

dated 16.09.2014 has been entered into. The petitioner has unconditionally apologised to the respondent and she has accepted his apology.

3. Respondent No.2 is present in court in person, represented by his counsel and identified by the Investigating Officer. She submits that she has settled the disputes with the petitioner and does not wish to press the complaint against him any further.

4. In view of the fact that the disputes between the petitioner and respondent No.2 have been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.

5. In view of the above, the petition is allowed. FIR No.57/2013 under Sections 354/341/323/506 at Police Station Sunlight Colony and the consequent proceedings emanating therefrom are accordingly quashed.

6. Order Dasti under signatures of the Court Master.
