HON'BLE MR JUSTICE SANJEEV SACHDEVA

                              JUDGMENT

26.07.2018

SANJEEV SACHDEVA, J. (ORAL)

1. Petitioner seeks quashing of FIR No.69/2018 under Sections 354A/509 of the IPC at Police Station Connaught Place, New Delhi.

2. It is alleged that the petitioner misbehaved with the complainant who had come to Connaught Place along with her family. The petitioner has apologised to the complainant. They have entered into a settlement dated 20.07.2018. Petitioner has also apologised to the complainant.

3. Respondent No.2 who is present in court in person is identified by the Investigating Officer, she confirms that she has settled with the petitioner and does not wish to prosecute the petitioner.

4. In view of the fact that the disputes between the petitioner and respondent No.2 have been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating there from.

5. In view of the above, the petition is allowed. FIR No.69/2018 under Sections 354A/509 of the IPC at Police Station Connaught Place, New Delhi and the consequent proceedings emanating there from are accordingly quashed.

6. Order Dasti under signatures of the Court Master.
