1. Petitioners seek quashing of FIR No.21 of 2015 under Sections 308/34 of the IPC, Police Station New Ashok Nagar.
2. The parties are known to each other for several years. The subject FIR was registered consequent to a dispute which took place between the parties on account of use and non-return of memory card of a mobile phone. The nature of injuries sustained were simple.
3. Learned counsels for the parties submit that the parties have settled their disputes with the intervention of other members of the
family and respectable members of the society. The compromise deed dated 17.07.2018 has been executed. Both the parties confirm the settlement they assured that they shall not quarrel in future.
4. Respondent No.2 is present in court in person, represented by his counsel and identified by the Investigating Officer. He submits that he has settled the disputes with the petitioners and does not wish to press the complaint against them any further.
5. In view of the fact that the disputes between the petitioners and respondent No.2 have been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.
6. In view of the above, the petition is allowed. FIR No.21/2015 under Sections 308/34 IPC, Police Station New Ashok Nagar and the consequent proceedings emanating therefrom are, accordingly quashed.
7. Order Dasti under signature of the Court Master.
