Exemption is allowed subject to all just exceptions.

1. Petitioner seeks quashing of FIR No.656/2013 under Sections 354/354A IPC, Police Station Saraswati Vihar (now Police station Subhash Place) based on a settlement.

2. Allegations against the petitioner are that the petitioner misbehaved with the complainant consequent to which the subject FIR was lodged.

3. With the intervention of the respectable elder members of the Society, family members and friends, the parties have amicably settled their disputes.

4. Petitioner has apologised to respondent No.2 and has shown regret for his conduct. He has undertaken not to repeat his conduct.

5. Respondent No.2 is present in Court in person and identified by the Investigating Officer. She has filed supporting affidavit as well as her identity proof. She confirms that she has arrived at a Settlement with a view to maintain peace and harmony in the locality and further submits that she does not wish to press her complaint any further.

6. In view of the above and keeping in view of the fact that the parties have resolved their dispute with the intervention of respectable members of the Society with a view to restore peace and harmony between them and a settlement has been arrived at between the parties, and further the complainant does not wish to press charges against the petitioner, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be

expedient to quash the subject FIR and the consequent proceedings emanating therefrom.

7. Accordingly, FIR No. 656/2013 under Sections 354/354A IPC, Police Station Saraswati Vihar (now Police station Subhash Place), and the consequent proceedings emanating therefrom are hereby quashed.

8. Order Dasti under signatures of Court Master.
