1. Petitioner seeks quashing of FIR No.239/2014 under Sections 420/468/471 IPC at Police Station Darya Ganj.

2. Valakatnama on behalf of respondent No. 2 has been filed. The same is taken on record.

3. Subject FIR has been registered on the allegation that the petitioner had forged the signatures of respondent the landlord for the purposes of obtaining a health license from the Municipal

Corporation.

4. Learned counsels for the parties submit that the parties have settled their disputes and Compromise Deed cum Memorandum of Understanding dated 04.08.2015 has been executed.

5. It is contended that not only the dispute, subject matter of the present FIR but there were other disputes between the parties which have also been settled. It is contended that the complaint filed by the wife of the petitioner has already been withdrawn and other cases filed by respondent No.2 already stand withdrawn.

6. Respondent No.2 is present in court in person, represented by his counsel and identified by the Investigating Officer. He submist that he has settled with the petitioner and does not wish to press the complaint any further.

7. In view of the fact that the disputes between the petitioner and respondent No.2 have been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIRs and the consequent proceedings emanating there from.

8. In view of the above, the petitions are allowed. FIR No.239/2014 under Sections 420/468/471 IPC at Police Station Darya

Ganj and the consequent proceedings emanating there from are, accordingly quashed, subject to payment of costs of Rs.10,000/- to be paid to Delhi High Court Bar Association Employees Welfare Fund within a period of two weeks. Receipt of deposit of cost be furnished to the Investigating Officer, within three weeks.

9. Order Dasti under signatures of the Court Master.
