1. Vide impugned order of 30th June, 2017 (Annexure P-1), petitioner's service as Anganwadi worker stands terminated by the concerned officer of Department of Women and Child Development, Government of NCT of Delhi. In this petition, quashing of impugned order of 30th June, 2017 and reinstatement of petitioner with back wages is sought.
2. At the outset, learned counsel for first respondent, submits that there is a jurisdictional issue. While drawing attention of this Court to Section 14 of The Administrative Tribunals Act, 1985 it is asserted by W.P.(C) 1053/2018 Page 1 respondent's counsel that for the relief claimed in this petition, petitioner has to approach Central Administrative Tribunal, New Delhi.
3. Since it is the mandate of Section 14 of The Administrative Tribunals Act, 1985 that all service matters pertaining to Government of NCT of Delhi are to be dealt with by the Central Administrative Tribunal, New Delhi, therefore, this petition and applications are disposed of with liberty to petitioner to approach the Central Administrative Tribunal, New Delhi for the relief claimed in this petition.
