1. The petitioner seeks quashing of FIR No. 1140 of 2014 under Sections 354/323 of the IPC registered at Police Station Begumpur,
New Delhi, based on a settlement.
2. The parties were neighbours at the time of the incident. It is alleged in the FIR that the petitioner had attempted to hit the children of the locality who were playing because a ball with which they were playing had hit his car. Subsequently, when complainant as well her nephew had attempted to intervene he assaulted them.
3. Learned counsels for the parties submit that the parties have settled their disputes with the intervention of friends and family. Parties have settled their disputes and a Compromise/Settlement Deed dated 13.08.2018 has been executed. Petitioner who is present in person has regretted his conduct and assures that he shall not repeat the same.
4. Respondent No.2 who is present in Court in person is represented by a counsel and identified by the Investigating Officer. She submits that she has settled the disputes with the petitioner and is agreeable to the settlement and does not wish to press the criminal charges against him any further.
5. In view of the fact that the disputes between the petitioner and respondent no. 2 have been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case
demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating there from qua the petitioners.
6. In view of the above, the petition is allowed. FIR No. 1140 of 2014 under Sections 354/323 of the IPC registered at Police Station Begumpur, New Delhi and the consequent proceedings emanating there from are accordingly quashed qua the petitioners.
7. Order Dasti under signatures of the Court Master.
