SANJEEV SACHDEVA, J. (ORAL) CM Appl.29006/2018 (exemption) Exemption is allowed subject to all just exceptions. CRL.M.C. 3807/2018

1. Petitioners seek quashing of FIR No.456/2015 under Sections 354D/506/509 of the IPC at Police Station Mayapuri.

2. The petitioner was the husband of the complainant. The allegation is that the petitioner entered into the office of the complainant and misbehaved with her.

3. Learned counsels for the parties submit that the parties have settled their disputes. The FIR emanates out of matrimonial discord.

4. Respondent No.2 who is present in court in person and identified by the IO submits that since the petitioner has apologised and she has accepted the apology, she does not wish to press the complaint any further and has no objection to the quashing of the subject FIR. The statement of the parties is also recorded by the Trial Court on 31.01.2018 to the said effect.

5. In view of the fact that the disputes between the petitioner and respondent No.2 have been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.

6. In view of the above, the petition is allowed. FIR No.456/2015 under Sections 354D/506/509 of the IPC at Police Station Mayapuri and the consequent proceedings emanating therefrom are accordingly quashed.

7. Order Dasti under signatures of the Court Master.
