                                  JUDGMENT

25.04.2018 SANJEEV SACHDEVA, J. (ORAL)

1. The petitioner seeks regular bail in FIR No.467/2016 under Sections 420 and 120B of the IPC, PS Kotla Mubarakpur.

2. The allegations are that the petitioner was one of the Directors of Cupid Holidays Pvt. Ltd. It is alleged that over 25 tickets were booked through the said company which were subsequently cancelled and refunds taken from the airlines and misappropriated.

3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated and petitioner though was a Director was not handling the day-

BAIL APPLN. 2347/2017 Page 1 to-day affairs with regard to the booking of flights and is not beneficiary of any of the refund amount. He submits that the day-to-day affairs used to be managed by the other Director, who is the real maternal uncle of the petitioner and he has since been declared a proclaimed offender.

4. Petitioner was incarcerated on 08.07.2016 and as on 18.01.2018 petitioner had spent 1 year 6 months and 7 days in custody. By order dated 07.03.2018, the petitioner was granted interim bail till 02.04.2018 with a direction to surrender on the said date. The petitioner duly surrendered in the terms of the order of the Court. Thereafter on 04.04.2018 petitioner was once again granted interim bail and is under the same protection. The petitioner is present in Court in person.

5. Without commenting on the merits of the case, the perusal of the record shows that petitioner has made out a case for grant of bail. Accordingly, petitioner is granted bail subject to furnishing a bond in the sum of Rs.25,000/- with a surety of the like amount to the satisfaction of the Trial Court.

6. Petitioner had submitted a bond in the sum of Rs.25,000/- as well as a surety as a pre-condition to grant of interim bail. Said bond and surety shall enure as bond and surety for the grant of bail. The petitioner shall not do anything which shall prejudice the trial of the prosecution witnesses. The petitioner shall not leave the country without the permission of the Trial Court.

7. Petition is accordingly disposed of in the above terms.
