1. The matter was passed over on the first call as none was present for the petitioner. Same is the position on the second call.

2. It is pertinent to note that when the case was listed on 25.2.2016, as none was present for the petitioner, however, in the interest of justice, it was adjourned to 5.2.2016, on which date, this Bench had not assembled. However, it appears that counsel for the petitioner had not turned up on the said date, as is apparent from a perusal of the order sheet of 5.2.2016.

3. It appears that the petitioner is not interested in prosecuting the present petition, which is accordingly dismissed in default and for non- prosecution, along with the pending application.
