1. The present petition has been filed by the petitioner praying

inter alia for issuance of directions to the respondents to promote him

as a Head Constable at par with other similarly placed Constables in

terms of the approved list dated 12.12.2012 alongwith seniority, back

wages etc.

2. Counsel for the petitioner states that during the pendency of the

present petition, vide Office Order dated Nil February, 2014 enclosed

with the counter affidavit as Annexure R-1, the petitioner has been

appointed as a Head Constable w.e.f. November, 2012. He states that

the petitioner is entitled for promotion to the post of Head Constable

w.e.f. January, 2012 and not November, 2012 and he is proposing to

file a representation with the respondents on the said lines.

3. In view of the submission made by the counsel for the

petitioner, the present petition is disposed of as infructuous with

liberty granted to the petitioner to submit a representation to the

respondents with regard to his remaining grievance within two weeks

from today. As and when the respondents receive such a

representation, the same shall be considered and decided as per law

by passing a speaking order within four weeks, under written

intimation to the petitioner. If the grievance of the petitioner still

survives, he shall be entitled to seek his remedies in accordance with

law.

4. The petition is disposed of.
