1. Counsel for the Judgment Debtor hands over a draft bearing

No.030045 dated 4.1.2016 drawn on Canara Bank, Deen Dayal

Upadhayaya Marg, New Delhi in the sum of Rs.12,33,553/-, in favour

of the Decree Holder, to the counsel for the Decree Holder, which is

duly accepted by him. He states that the said amount is in satisfaction

of the judgment and decree dated 4.4.2013 passed in

CS(OS)No.710/2009 that was modified by the Division Bench, vide

order dated 23.9.2013, passed in RFA(OS)No.70/2013.

2. Counsel for the Decree Holder states that on receiving the

aforesaid amount, nothing further survives for adjudication in the

present execution petition, which may be disposed of.

3. Needless to state that proceedings in CS(OS)No.710/2009 shall

continue in accordance with law.

4. On the last date of hearing, the Registry was directed to furnish

a report explaining its failure to place the file of CS(OS)No.710/2009

before the Court after the order dated 4.4.2013 came to be passed in

the captioned suit. The Registry has filed a report which the Court has

perused. While cautioning the dealing hand to be more careful in the

future, the explanation offered is accepted.

5. The execution petition is disposed of.
