1. On the last date of hearing, none was present for either side. It

was noted that the suit had been adjourned sine die with liberty

granted to the plaintiff to file an application for seeking revival of the

suit, if it would be able to obtain leave from the Company Court for

prosecuting the same against the defendant. Court notice of default

was issued to the plaintiff directly as also through counsel, returnable

for today.

2. As per the office report, the plaintiff and its counsel have been

served. However, neither of them are present today.

3. It appears that the plaintiff is not interested in prosecuting the

present suit, which is accordingly dismissed in default and for non-

prosecution.
