1. Counsels for the plaintiff and the defendants No.2 and 3 jointly

state that they have arrived at a settlement as reduced into writing

vide Deed of Settlement dated 29.10.2015, which they propose to file

before the Company Law Board. True copy of the Deed of Settlement

dated 29.10.2015 is handed over by the counsels for the parties and

taken on record.

2. Counsel for the plaintiff states that in terms of the settlement

recorded in the Deed of Settlement, the plaintiff has undertaken to

withdraw the present suit and he, therefore, seeks leave to do so.

Counsel for the defendants No.2 and 3 confirms the aforesaid position.

3. Leave, as prayed for, is granted. The suit is dismissed as

withdrawn alongwith the pending applications in view of the

settlement arrived at between the parties.
