1. By a separate order passed today in CS(OS) No.3721/2014, the
settlement arrived at between the parties and recorded in a
compromise application, registered as IA No.23701/2015, has been
taken on record and the suit has been decreed in terms of the said
settlement. One of the terms and conditions of the settlement is that
the petitioners herein shall withdraw the present petition.
2. Though the next date of hearing in the present case is
12.2.2016, at the joint request of the counsels for the parties, the file
of the present petition was requisitioned from the Registry and the
case has been circulated in the Supplementary Cause List.
3. Counsel for the petitioners states that in terms of the settlement
arrived at with all the legal heirs of Late Lt.General Ajit Singh and the
beneficiaries of the will dated 5.1.2007 executed by the deceased, as
recorded in the captioned suit, the petitioners seek leave to withdraw
the present petition.
4. Leave, as prayed for is granted. The petition is dismissed as
withdrawn, along with pending application.
The date of 12.2.2016 stands cancelled.
