The learned counsel for the contesting respondent/respondent no.1 cannot but argue that the facts obtaining in the present case are covered by the judgment dated 17.09.2015, passed in WP(C) 5323/2015, titled : Kalpana Thakur and Anr. Vs. CBSE and Anr.

Briefly, by this writ petition, the petitioner seeks a change in his name from 'Safwan K.S.' to 'Safwan Shafeeque Kadambot'. Vide the impugned communication issued by the CBSE, the request was rejected. The reason simply given was that the request made is not allowed, as per rules.

As indicated above, this aspect of the matter has been examined in the aforementioned judgment.

W.P.(C) 9708/2015 page 1 of 2 It is the case of the petitioner that a request was sent via the principal of the concerned school i.e. Birla Public School, Qatar on 16.06.2014 which was the date prior to the issuance of the office order dated 16.02.2015. This aspect of the matter is covered by the aforementioned judgment.

Accordingly, the writ petition is allowed. The impugned communication is quashed. Respondent no.1/CBSE shall effect the change in name in the petitioner's class X and XII certificates as prayed, within four weeks from today.

The writ petition and the pending application are accordingly, disposed of.
