1. Counsel for the plaintiff/bank states that during the pendency of
the present proceedings, the bank has vacated the suit premises and
deposited the keys thereof in the Registry. He states, on instructions,
that having done so, the plaintiff/bank is no longer interested in
pursuing the present suit any further. However, the plaintiff/bank
reserves its right to contest CS(OS) No.1370/2009 instituted by the
defendant No.1 in respect of the suit premises and take all the pleas
as have been taken in the written statement.
2. The suit is dismissed as withdrawn, while reserving the right of
the plaintiff, as prayed for above.
