In this petition, direction is sought to respondent-State to register an FIR.

The incident of 15th April, 2015 relates to petitioner's daughter dying unnatural death in her matrimonial house. Petitioner's daughter had suffered burn injuries and was taken to Safdarjung Hospital where she was treated and she had ultimately died on 19th April, 2015. Petitioner's daughter was married in May, 2011. Regarding death of petitioner's daughter on 19th April, 2015, petitioner had made a complaint (Annexure- A) to the concerned Assistant Commissioner of Police and another complaint (Annexure-B) to the concerned SDM seeking registration of the FIR in question regarding the incident of 15th April, 2015.

CRL.M.C. 1804/2015 Page 1 According to petitioner, no action has been taken on petitioner's complaints (Annexures- A & B).

Upon notice, learned Additional Public Prosecutor for respondent- State submits that on the complaints of petitioner, DD No.43-B was registered and was inquired into. Copy of the statement made by the deceased to the local SDM has been shown to the court, which indicates that the death of petitioner's daughter was accidental. Regarding the cause of death, a query was put to learned Additional Public Prosecutor for respondent-State and it was disclosed that the post-mortem report is awaited and is likely to be received within a period of two weeks.

Upon hearing and on perusal of the complaints in question, this petition is disposed of with direction to respondent-State to take into consideration the post-mortem report of the deceased and thereafter, to proceed in respect of DD No.43-B registered on 30th April, 2015 while taking into consideration the dying declaration of the deceased.

With aforesaid directions, this petition is disposed of.
