E.A. 252/2015 (for condonation of delay in re-filing the accompanying petition)
1. The present application has been filed by the Decree Holder
praying inter alia for condonation of delay of 24 days in re-filing the
accompanying execution petition.
2. For the reasons stated the application, the same is allowed. The
delay of 24 days in re-filing the petition is condoned.
3. The application is disposed of.
EX.P. 97/2015
1. The present petition has been filed by the Decree Holder praying
inter alia for execution of the ex parte judgment and decree dated
31.10.2014 passed in CS(OS)1719/2013.
2. Counsel for the Decree Holder states that the Judgment Debtor
is a permanent resident of Ghaziabad, UP and requests that a Transfer
Certificate be issued for execution of the judgment and decree,
through the court of the District Judge, Ghaziabad.
3. Ordered accordingly. The Registry is directed to prepare a
Transfer Certificate in respect of the impugned judgment and decree
for the Decree Holder to pursue his remedies against the Judgment
Debtor before the competent court in Ghaziabad, UP.
4. The execution petition is disposed of.
