1. Learned counsel for the defendants states that aggrieved by the

rejection order dated 08.07.2013 passed in I.A.5932/2013, an

application filed by the defendants under Order VII Rule 11 CPC, the

defendants had filed an appeal before the Division Bench, registered

as FAO(OS) 367/2013. Further, aggrieved by the order dated

06.08.2013 passed in I.A.1035/2013, an application filed by the

plaintiff under Order XXXIX Rule 1 and 2 CPC, the defendants had filed

another appeal before the Division Bench, registered as FAO(OS)

420/2013. The decisions in the said appeals were being awaited.

2. Today, counsel for the defendants hands over a copy of the

common judgment dated 18.09.2015, passed by the Division Bench,

whererunder both the appeals have been allowed and the present suit

has been rejected. Further, the order dated 06.08.2013, granting an

interim injunction in favour of the plaintiff has been set aside. The

said judgment is taken on record.

3. In view of the above position, nothing further survives for

adjudication in the present suit, which has been rejected. The suit is

disposed of alongwith the pending application.
