Hon'ble Sudhanshu Dhulia, J.

Heard Mr. Mohd. Allaudin, Advocate holding brief of Mr. Manish Arora, learned counsel for the applicant, Mr. B.M. Pingal, learned Brief Holder for the State and perused the record.

The applicant is in jail being implicated in Case Crime No. 41 of 2014, which has been registered under Sections 395/412 of I.P.C., Police Station Bhagwanpur, District Haridwar.

The co-accused, namely, Raees Ahmad has been granted bail by this Court vide order dated 06.09.2014. The role assigned to the present applicant also stands on a similar footing as that of the co-accused. The applicant is in jail since 25.03.2014.

Considering the facts and circumstances of the case as well as the material available on record, the applicant has been able to make out a case for bail. The bail application is accordingly allowed.

Let the applicant (Nasim) be enlarged on bail in the aforesaid crime on his executing a personal bond and

two reliable sureties of the equal amount to the satisfaction of the Magistrate concerned.

It is made clear that any observations made by this Court are only for the purposes of grant of bail. It shall not be taken into consideration by the trial court.
