Counter affidavit filed by the State today in the Court is taken on record.

Heard Mr. Harshpal Sekhon and Mr. Lalit Sharma, learned counsels for the applicant, Mr. B.M. Pingal, learned Brief Holder for the State and perused the record.

The applicant is in jail being implicated in F.I.R. No. 356 of 2014, which has been registered under Sections 420/467/468 of I.P.C., Police Station Rudrapur, District Udham Singh Nagar.

The applicant is in jail since 23.07.2014. Considering the facts and circumstances of the case as well as the material available on record, the applicant has been able to make out a case for bail. The bail application is accordingly allowed.

Let the applicant (Gurucharan Singh @ Lucky) be enlarged on bail in the aforesaid crime on his executing

a personal bond and two reliable sureties of the equal amount to the satisfaction of the Magistrate concerned.

It is made clear that any observations made by this Court are only for the purposes of grant of bail. It shall not be taken into consideration by the trial court.
