CORAM:
HON'BLE MR. JUSTICE SURESH KAIT

SURESH KAIT, J. (Oral)

1. By way of the present petition, the petitioner seeks quashing of the orders dated 26.09.2007 and 07.03.2008 issued by the respondent/Delhi Transport Corporation.

2. Learned counsel appearing on behalf of the respondent submits that the petitioner initially challenged the aforementioned order dated 26.09.2007 vide W.P.(C) No. 742/2010, however, the same was dismissed as withdrawn with liberty to file a fresh petition in view of the subsequent order passed by the Management on 26.09.2007 granting him promotion with effect from 01.06.1995.

3. Earlier the jurisdiction to deal with the matters relating to DTC was with this Court, however, w.e.f. 10.11.2010, the same was transferred to the Central Administrative Tribunal (in short 'CAT').

4. In view of above, learned counsel for the respondent submits that since this case is a service matter and pertains to DTC, therefore, the petitioner may approach CAT.

5. At this stage, learned counsel for the petitioner submits that the present petition may be transferred to CAT for disposal.

6. Keeping in view the issue raised in the instant petition and the fact that the present case has been filed by the workman, in the interest of justice, I direct the Registry of this Court to transfer this case to CAT, who shall adjudicate upon the present petition on merits.

7. Accordingly, the parties are directed to appear before CAT on 25.11.2014 for directions.
