05.   22.08.2013                 Heard learned counsel for the parties.

                                 This writ petition has been filed praying for a
                   direction to the Accountant General of Orissa-opposite party no.2
                   in not releasing the entire family pension in favour of the opposite
                   party no.3.

                                 The case of the petitioner is that she is the mother of
                   the deceased employee, namely, Ratikanta Parida, who was
                   working as PMT Assistant Driver vide Batch No.1010 in the Police
                   Department at Baripada in the district of Mayurbhanj and died on
                   30.06.2012 due to heart attack while on duty. As the petitioner is
                   the mother of the deceased employee, she is entitled to a part of
                   the family pension payable along with opposite party no.3. It is
                   stated that a representation in this regard has been submitted to
                   the Superintendent of Police, Mayurbhanj-opposite party no.1,
                   dated 10.06.2013, as per Anneuxre-1 to the writ petition, which
                   according to the petitioner is pending consideration.

                                 Without going into the merits of the case, this writ
                   petition is disposed of with a direction to the Superintendent of
                   Police,   Mayurbhanj-opposite      party   no.1   to   dispose   of   the
                   representation of the petitioner dated 10.06.2013        (Annexure-1),
                   if the same is still pending, as expeditiously as possible,
                   preferably within a period of eight weeks from the date of receipt
                   of certified copy of this order.

                                 W.P.(C) is accordingly disposed of.

                                 Issue urgent certified copy as per rules.
