Respondent/wife has filed the requisite affidavit as per directions of this court dated 03.08.2011.

Petitioner had filed a divorce petition against the respondent/wife which is pending disposal before the learned trial court. During the pendency of the petition, an application under Section 24 of Hindu Marriage Act was filed by the wife wherein maintenance @ Rs. 10,000/- per month has been awarded to the respondent/wife vide order dated 06.09.2007. The said order is under challenge before this court. Initially, the operation of the impugned order was stayed. However, on 11.11.2008, this court had vacated

the interim order and directed the petitioner to clear the arrears. On 04.01.2012, the learned counsel for respondent/wife pointed out that the petitioner has still not cleared the substantial amount towards arrears of maintenance pendente lite. On the said date, petitioner was directed to clear the same within two weeks and the matter was adjourned to 22.02.2012. Again on 22.02.2012, the learned counsel for respondent/wife has pointed out that there are still arrears of Rs. 2.35 lakhs. Petitioner was given four weeks' time to clear substantial amount of arrears of maintenance pendente lite. Despite that, petitioner has not cleared the arrears. Petitioner is a Chartered Accountant by profession.

The petition stands dismissed for non-clearance of arrears of maintenance pendente lite.

CM No. 3193/2012 (modification of order dated 04.01.2012)

In view of the order on the main petition, no further orders are required on the present application.

The same stands disposed of.
