1.   This appeal arising from ITA 39/1999 between the same

parties (M/s. Whirlpool of India Ltd. was earlier known as

Kelvinator of India Ltd.) was directed to be heard alongwith ITA

39/1999.   The said appeal having been dismissed, the present

appeal will not survive and thus, is accordingly dismissed.
