1. This writ petition has been filed for the reason that the
petitioner's appeal assailing his rejection for appointment to
the post of Head Constable in the Border Security Force in the
year 2010 has not been considered favourably on the ground of
medical fitness. The petitioner contends that he has preferred
an appeal dated 14th July, 2010 before the Director General of
the Border Security Force enclosing the requisite certificate
from the medical practitioner but no orders have been passed
thereon.
2. Ms. Jyoti Singh, appearing on behalf of respondents on
advance notice, contends that the appeal which was received
by the respondent was not accompanied by all documents
which have been placed before this Court. Subject to the
petitioner's placing the originals of the documents which have
been annexed as annexure at page 28A with the Director
General of the Border Security Force, appropriate orders in
accordance with law would be passed on the petitioner's
appeal.
3. This writ petition is accordingly disposed of with the
following directions:
(i) the petitioner shall file the original of the document
annexed at page 28 A of the present paper book
with the Director General of the Border Security
Force within a period of one week from today.
(ii) upon receipt of the document as directed above, the
pending appeal of the petitioner shall be disposed of
within a period of two weeks.
(iii) the order which is passed shall be communicated to
the petitioner who shall be at liberty to assail the
same by way of appropriate legal proceedings, in
case he is still aggrieved thereby.
This writ petition and application are disposed of on the
above terms.
Copy of this order be given dasti to both the parties under
the signatures of court master.
