This is a petition against the interim order passed by the Tribunal

dated 5th March, 2010 in O.A No.736/2010. The learned counsel for the

petitioner has disclosed that the Tribunal has allowed the O.A vide

order dated 23rd April, 2010.

Since the original application of the respondent has been allowed

by the Tribunal by order dated 23rd April, 2010, the interim order dated

5th March, 2010 will merge with the final order and will not survive and

the writ petition against the interim order dated 5th March, 2010 will

not be maintainable.

In the circumstances, petition is dismissed as not maintainable.

All the pending applications are also disposed of.

The petitioner shall, however, have liberty to raise all the points

raised in the present petition in case the petitioner files any petition

against the order dated 23rd April, 2010 passed by the Tribunal

disposing of O.A No.736/2010.
