By the present petition, the petitioner has assailed an order of learned Sr.
Civil Judge whereby an application of the petitioner for condonation of delay in filing
the appeal was dismissed. The learned Appellate Court observed that the petitioner
was supposed to explain each and every day's delay but he failed to do so and the
petitioner could not bring on record sufficient material to condone the delay. I
consider that it is a fit case where notice should be sent to the respondent.
Issue notice of the petition and the application to the respondent returnable
for 14th July, 2010.
