The petitioner, who is selling vegetables on Rehari from outside Chabutra
situated at the corner of Gali No.8, Subzi Wali Gali, Kailash Nagar, Delhi-110031
claims that he is entitled to Teh Bazari license/right to operate and do business
from the said location or from any other alternative site.
In view of the decision of the Supreme Court in Patri Vyapar Mandal Delhi
Vs. MCD, Town Hall (2009) 12 SCC 475 and subsequent orders and the National
Policy on urban street vendors ('NPSV' Scheme) 2004, the petitioner is required
to approach the Zonal Vending Committee along with necessary documents.
The writ petition is accordingly disposed of with liberty to the petitioner to
approach the Zonal Vending Committee with an application and necessary
documents. The petitioner will not be dispossessed from the present site for a
period of one month to enable the petitioner to approach the Zonal Vending Committee. The petitioner, however, will not construct any permanent structure
and will abide by Teh Bazari rules.
