The petitioner was granted ad-hoc meat trade registration license, which

was renewed from time to time.

2. The petitioner's application for grant of regular meat trade license is not

being considered and replied to. This, compel the petitioner to approach this

Court.

3. The respondent, MCD in their reply have admitted that the petitioner

had applied for regular meat trade license but has not submitted rent

agreement and 'no object certificate' from the land lord, which are essential

requirements for grant of regular meat trade license.

4. Counsel for the petitioner, however, has drawn my attention to the

agreement dated 16th September, 2002 entered into between the petitioner

and his landlord. In clause 5 of the said agreement, the land lord has stated that

WPC No.9969/2009 Page 1 he has no objection to running of a meat shop from the premises in question.

The respondents in their counter affidavit have not alleged that the said

agreement is forged and fabricated. The landlord has not written any letter or

made any allegation to the said effect. Accordingly, directions are issued to the

respondents to process the case/application of the petitioner on the basis of the

agreement dated 16th September, 2002. In case no adverse material or evidence

is found, which shows that the agreement is forged and fabricated, the same

will be treated as legal and valid for the purpose of grant of regular meat trade

license. The aforesaid exercise will be completed within six weeks from the date

copy of this order is received.

The writ petition is disposed of.
